Činnost probační a mediační služby při výkonu alternativních trestů

Abstract

Tato práce, nazvaná Činnost probační a mediační služby při výkonu alternativních trestů, má za cíl popsat roli Probační a mediační služby ČR zejména při zajištění výkonu alternativních sankcí, její legislativní zakotvení a případné problémy, které mohou nastat při těchto činnostech. Probační a mediační služba ČR je organizací, která napomáhá uplatňování principů restorativní justice a zefektivňuje alternativní sankcionování. V České republice tyto činnosti dříve vykonávaly různé osoby, samotná specializovaná Probační a mediační služba je poměrně mladá, působí od roku 2001. Práce je členěna do 10 kapitol, které se zabývají různými dílčími tématy. Samostatná kapitola je věnována historickému vývoji alternativního trestání a probace. Důležitou kapitolou je část definující pojem alternativního trestu a zákonný základ těch trestů, jejichž výkon zajišťuje Probační a mediační služba. Práce obsahuje také popis struktury Probační a mediační služby, práva a povinnosti jejích pracovníků a informovanost české veřejnosti o této instituci. Nejdelší kapitolou je podrobný popis praktické stránky výkonu alternativních trestů z pohledu probačních úředníků. This thesis, called Activities of the probation and mediation service in serving alternative sanctions aims to describe a role of the Probation and mediation service of the Czech Republic especially in serving alternative sentences, its legal base and problems, which may occur during these activities. Probation and mediation service of the Czech Republic is an organization which helps to apply the principles of the restorative justice and provides more effective exercise of the alternative sanctions. Different persons and institutions had been in charge with these tasks but the specialized Probation and mediation service is young, it has been established in 2001. The thesis consists of ten chapters, which deal with various partial topics. A separate chapter deals with a historical evolution of the alternative sanctions and probation. A part with the definition of the alternative sentence and a legal base of those sentences whose exercise is assured by the Probation and mediation service is an important chapter. The thesis also contains a description of the structure of the Probation and mediation service, rights and duties of its officers and awareness among Czech public.
