Stanovy českých politických stran

Abstract

Bachelor thesis studies the subject matter of the Articles of three Czech political parties - Social democrats (ČSSD), Christian People's Party (KDU-ČSL) and Civic Democratic Party (ODS). It aims to describe in the most detailed way how Articles have evolved in twenty-five year period since the Velvet revolution until today. The paper focuses on membership in those parties, how it is established, how it can be canceled and what rights and duties are jointed with the membership. Thesis also describes party's bodies, their mutual relationships and powers they have towards the regular member (and conversely). Parties' inner democratic principles and their impact on parties' structure nor topics as membership fees aren't omitted. Research method chosen for the thesis is qualitative analysis of more than forty documents, some of which are older than twenty-five years. They have been archived by Ministry of the Interior of the Czech republic. Based on political science theories the author derives four hypotheses, which he subsequently verifies by studying law as a system of obligatory rules, which parties have to project into their Articles and organizational structure and parties'Articles themselves as formal prescriptive to obey.

Práce nastiňuje obsah stanov vybraných politických stran, tedy ČSSD, KDU-ČSL a ODS. Snaží se co nejdetailněji popsat, jak se vyvíjely vybrané instituty v nich obsažené od roku 1991 do současnosti. Prostor je věnován především úpravě členství se zvláštní pozorností na jeho vznik, obsah (jde především o práva a povinnosti členů, jak jim je stanovy přiznávají a přikazují) a zánik. Další oblast studia se zaměřuje na přidružené organizace a vývoj jejich postavení vůči politické straně. Práce také sleduje postavení jednotlivých stranických orgánů především vůči členům - kdo může člena ze strany vyloučit a proč - a povšechně rovněž vůči sobě navzájem a vůči přidruženým organizacím. Mimo nezůstává ani otázka vývoje vnitrostranické demokracie a jejích dopadů na stranickou strukturu, úprava členských příspěvků a postoj stany k neplatičům, stejně jako k účelovému vstupování do strany. Metoda práce je kvalitativní analýza textu více než čtyřicítky dokumentů archivovaných Ministerstvem vnitra České republiky. Z politické teorie vyvozuje autor celkem čtyři hypotézy, které se následně snaží ověřit studiem formálních podmínek pro existenci politických stran a hnutí (tedy zákonné úpravy) a jejich vnitřních pravidel (stanov).
