Abstract

Shrnutí Diplomová práce se zabývá zkoumáním platné a účinné právní úpravy účtu, která kvůli rekodifikaci soukromého práva doznala určitých změn. Jejím cílem je, vedle samotného zkoumání dané právní úpravy, zdůraznit nejzásadnější změny přijaté do právní úpravy v souvislosti s nabytím účinnosti občanského zákoníku a upozornit na zákonná ustanovení, u nichž se lze v současné době setkat s rozdílnými názory autorů odborné literatury ohledně jejich výkladu. Práce používá metody systematické analýzy a komparace. V první kapitole jsou uvedeny relevantní právní předpisy, nová systematika právní úpravy a v neposlední řadě přechodná právní úprava. Dále je definován pojem účet a zmíněny některé související otázky. Následující kapitola se věnuje obecným ustanovením o účtu, tedy zejména smlouvě o účtu, nakládání s účtem a s peněžními prostředky na účtu, vedení účtu, úročení prostředků na účtu a nakonec důsledkům smrti majitele účtu a zániku závazku ze smlouvy o účtu. Na konci kapitoly jsou shrnuty některé odlišnosti od obecné právní úpravy pro případ, že se jedná o účet vedený pro více osob. Následující kapitola se věnuje platebnímu účtu a jeho právní úpravě obsažené v zákoně o platebním styku. The diploma thesis examines the effective legislation governing the bank account (or "accout"), which undergone some changes due to the recodification of the Czech private law. In addition to the actual examination of the accout legislation, it aims to highlight the most important changes adopted in connection with entering of the new Czech Civil Code into force and draw attention to the legal provisions, in respect of which some differing opinions regarding their interpretation could be met. The methods of systematic analysis and comparation were used. The first chapter sets out the relevant legislation, a new systhematics of accounts used by the laws and also the transitional provisions. Furthermore, the definition of the term "bank account" and some related issues are contained. The following chapter deals with the general provisions on account, namely account agreement, disposition with the account, disposing of the funds in the account, account management, crediting of interest and finally the consequences of the death of the account holder and termination of contractual obligations from the account agreement.
