Abstract

Pojem investice v mezinárodních dohodách na ochranu investic Abstrakt Tato diplomová práce analyzuje pojem investice, jak je upraven a interpretován v oblasti mezinárodního práva na ochranu investic. Práce je členěna do šesti kapitol. V první kapitole autor poskytuje základní charakteristiky mezinárodního práva na ochranu investic, jeho pramenů, specifik a cílů. V druhé kapitole je termín investice definován z hlediska ekonomického. Autor rozděluje zahraničních investice na přímé a portfoliové a zkoumá jejich odlišnosti i společné prvky. Třetí kapitolu tvoří rozbor základních typů definic investice obsažených v dohodách o podpoře a ochraně investic, kterými jsou definice syntetické a definice enumerativní. Ve čtvrté kapitole práce je zkoumán vztah mezi ekonomickou definicí investice a právní definicí investice. Pátá kapitola pojednává o významu pojmu investice v kontextu Úmluvy o řešení sporů z investic mezi státy a občany druhých států. Autor se nejprve zaměřuje na vyjednávací historii této mezinárodní úmluvy a dále pak na praxi rozhodčích tribunálů ustanovených na jejím základě. The concept of investment in international agreements on the protection of investments Resumé This thesis analyses the notion of investment in the context of international investment law. The thesis is composed of six chapters. The first chapter provides an overview of the international investment law, including its sources, specific features and goals. The second chapter provides an economic definition of the notion of investment. The author distinguishes between foreign direct investment and foreign portfolio investment and analyses their commonalities and differences. The third chapter deals with the basic types of definition of investment contained in international agreements on promotion and protection of foreign investments. These are the asset-based definition and enterprise-based definition. The fourth chapter examines the interaction between the economical and legal definition of investment. The fifth chapter explores the concept of investment in the context of the ICSID Convention. The authors analysed the negotiating history of the treaty as well as the case law of ICSID tribunals.
