Communism, judiciary, the right to a fair trial, the European Convention on Human RightsCílem práce je zmapovat a zhodnotit úroveň práva na spravedlivý proces v Československu v době po převzetí moci komunisty, a to ve vztahu k minimálním požadavkům kladeným Evropskou úmluvou o lidských právech. ČSR a později ani ČSSR Evropskou úmluvu neratifikovala, a tudíž nejde o posuzování z hlediska platného práva, ale z hlediska nadčasových principů spravedlivého procesu, které Úmluva vyjadřuje. O potřebě dodržet nadčasové principy spravedlivého procesu hovoří koneckonců i dnešní judikatura, konkrétně rozhodnutí Nejvyššího soudu ve věci Ludmily Brožové- Polednové, sp. zn. 7 Tdo 549/2008, a rozhodnutí Nejvyššího soudu ve věci Pavla Vítka, sp. zn. 7 TZ 179/99, kterou zpracovatel taktéž podrobil rozboru. Úmluva je vhodná ke srovnání taktéž s ohledem k době jejího vzniku, kdy v ČSR docházelo k tzv. "zostřování boje proti třídnímu nepříteli", jak komunistická terminologie ospravedlňovala stupňující se proces porušování práva na spravedlivý proces. Východiskem ale nebude pouze klasifikace jednotlivých případů porušování práva na spravedlivý proces ve smyslu čl. 6, popř. dalších práv a svobod dle uvedené Úmluvy, ke kterému docházelo v československé justici let 1948 - 1989, ale též pochopení tehdejší situace v právním prostředí, v době ovlivnění československého práva sovětským pojetím, které bylo...
The aim of the study is to map and judge the level of the right to a fair trial in Czechoslovakia after the communist revolution in relation to the minimum requirements imposed by the European Convention on Human Rights. Czechoslovakia did not ratified this Convention and therefore it is not regarded in terms of the applicable law, but in terms of timeless principles of fair trial as expressed in the Convention. Even present case law speaks about the need to comply with the timeless principles of a fair trial, namely the decision of the Supreme Court in the case Ludmila Brožová-Polednová, file number 7 Tdo 549/2008, and the decision of the Supreme Court in the case of Pavel Vítek, file number 7 TZ 179/99, which was also analysed by the author. The Convention is useful for comparing with regard to the time of its creation when there was in Czechoslovakia "intensification of the struggle against the class enemy" as Communist terminology justified escalating process of violations of the right to a fair trial.
