Směrnice o volném pohybu služeb a její implementace v českém právu

Abstract

Tato práce se zabývá směrnicí o volném pohybu služeb (směrnice č. 2006/123/ES, o službách na vnitřním trhu) a její implementací v českém právu. Práce je rozdělena do čtyř částí. V první části je stručně nastíněna úprava volného pohybu služeb a svobody usazování v primárním právu Evropské unie. Druhá část zkoumá samotnou směrnici, přičemž analyzuje proces jejího přijetí a dále zkoumá její obsah ve srovnání s dosavadní právní úpravou a určuje přínosy směrnice pro poskytování služeb na vnitřním trhu. Třetí část poskytuje přehled implementace v členských státech Evropské unie a představuje základ pro srovnání při hodnocení české právní úpravy. Čtvrtá část zkoumá implementaci směrnice v České republice, přičemž hodnotí její kvalitu na základě analýzy dvou implementačních zákonů, připomínek Evropské komise a srovnání s úpravou v ostatních členských státech. Výsledkem práce je závěr, že vypuštěním principu země původu z původního návrhu přišla směrnice o prvek, díky kterému by představovala razantní posun ve způsobu regulace volného pohybu služeb na vnitřním trhu oproti úpravě ve Smlouvě o fungování Evropské unie. Přínosy pro tuto oblast však směrnice přesto přináší, a to v přezkumu stávající legislativy členskými státy a ve změně nebo odstranění nepřípustných požadavků, dále díky zjednodušení získání...

This thesis deals with the Directive on the free movement of services (Directive 2006/123/EC, on services in the internal market) and its implementation in the Czech law. The thesis is divided into four parts. In the first part, there is a brief overview of the regulation of the free movement of services and the freedom of establishment in the primary law of the European Union. The second part examines the Directive itself while analysing the process of its enactment and then examines its content in comparison with the existing legal regulation and specifies the contributions of the Directive to the provision of services in the internal market. The third part provides an overview of the implementation in the European Union Member States and constitutes the basis for comparison for the assessment of the Czech legal regulation. The fourth part explores the implementation of the Directive in the Czech Republic while assessing its quality on the basis of the analysis of the two implementing acts, comments of the European Commission and comparison with the regulation in other Member States.
