Mimosmluvní instituty užití autorského díla

Abstract

- Česky Tématem práce jsou mimosmluvní instituty užití autorského díla. V těchto případech je možné užít autorské dílo bez souhlasu autora. Konkrétně se jedná o volné dílo a výjimky a omezení z práva autorského. Výjimky se dále člení na volné užití díla a zákonné licence. Zaobírám se také tzv. třístupňovým testem. Největší část práce věnuji volnému užití a úvaze nad jeho změnami. Samozřejmě se zmíním i o autorském právu obecně.

- English The topic of my thesis is non-contractual legal institutions of the use of copyrighted work. It describes the ways of use of copyrighted work without the contractual arrangement with the author. Namely, I talk about free work and exceptions and limitations of copyright. Exceptions are further divided into free use and statutory licences. I also deal with so-called three-step test. The largest part of the thesis is devoted to the free use and thoughts about its possible changes. Of course, I also mention the copyright law in general.
