Abstract

Cílem této diplomové práce je vytvořit ucelený přehled nejpoužívanějších chemických a biologických zbraní, vysvětlit jejich vývoj a vztahy mezi nimi, posoudit jejich existenci prismatem dobových zákonů, ať už obyčejových či psaných a v neposlední řadě i posoudit současnou právní úpravu problematiky z hlediska její efektivity a faktického dodržování. Tato práce se primárně zabývá právem mezinárodním, přičemž se pouze okrajově dotýká úpravy národní. Práce začíná vymezením pojmosloví, tedy konkrétně základních pojmů jako jsou zbraně hromadného ničení, chemické a biologické zbraně, mezinárodní právo, právo ozbrojených konfliktů, obyčejové právo, mezinárodní úmluvy, zakázané bojové prostředky a způsoby vedení ozbrojených konfliktů. Následuje pohled na nejranější historii chemických a biologických zbraní včetně krátkého zamyšlení nad absenci jakékoliv právní regulace. Jedná se o kapitolu, jejímž účelem je nastínit prvopočátky problematiky a posloužit jako rozšířený základ pro následující výklad. Práce pokračuje pojednáním o zrodu moderních chemických a biologických zbraní, založeného především na chemicko-biologické revoluci přelomu 19. a 20. století a současně uvádí výčet nejvýznamnějších kodifikačních počinů příslušného období (např. The goal of this diploma thesis is to present an overview of the most used chemical and biological weapons, as well as to explain their development, the links between them and their existence through the viewpoint of then contemporary sources, written or otherwise, as well as the current state of law in term of its effectivity and actual practice. The primary focus of this thesis is international law. National law is touched upon only sporadically. The first section of the thesis deals with the definition of used nomenclature, specifically the terms weapons of mass destruction, chemical and biological weapons, international law, law of armed conflicts, customary law, international treaties, forbidden means and methods of warfare. A look at the earliest history of chemical and biological weapons follows, including a brief assessment of the lack of legal regulation. The purpose of this chapter is to outline the very beginnings of this subject matter and to serve as a basis for the following chapters.
