Tato práce poskytuje základní přehled české právní úpravy obecné územní ochrany přírody a krajiny, a to za využití analytické metody. Primárním zdrojem této práce je zákon č. 114/1992 Sb., o ochraně přírody a krajiny. Práce je rozdělena do sedmi kapitol. První se věnuje úvodu do ochrany přírody a krajiny, vysvětlení pojmů a právním nástrojům s tím souvisejících. Další dvě kapitoly se zaměřují na mezinárodní, resp. evropský vývoj a dokumenty, jež ovlivnily právní úpravu obecné územní ochrany. Kapitola čtvrtá se zabývá stručně historií pozadím české právní úpravy. Hlavní část práce je soustředěna do kapitoly páté pojednávající o jednotlivých institutech obecné územní ochrany přírody a krajiny, tzn. o územních systémech ekologické stability, významných krajinných prvcích, ochraně dřevin rostoucích mimo les, ochraně neživé přírody, krajinného rázu, přírodního parku a přechodně chráněné plochy. Těmto nástrojům je věnována pozornost z hlediska úpravy obsažené v zákoně č. 114/1992 Sb., o ochraně přírody a krajiny, a to i v souvislosti s právními předpisy, které zákon doplňují. Šestá a sedmá kapitola pojednávají o otázkách týkajících se právní odpovědnosti v problematice ochrany přírody a krajiny a organizace veřejné správy. This thesis provides a basic overview of the Czech legislation on the general territorial protection of nature and landscape. The primary source of this thesis is the Act no. 114/1992 Coll., on the Protection of nature and landscape protection. The thesis is divided into seven chapters. The first chapter is to introduce a protection of nature and landscape and to explain the terms and legal instruments related thereto. The following two chapters focus on international and mainly European developments and documents that have influenced the legislation of the general territorial protection. The fourth chapter briefly describes the historical background of the Czech legislation. The main part of this thesis is concentrated in the fifth chapter which deals with individual tools of a general territorial protection of nature and landscape, ie. territorial systems of ecological stability, significant elements of the landscape, protection of trees outside forests, protection of inanimate nature, landscape character, natural park and temporarily protected area. These institutes are examined in terms of the rules contained in the Act no. 114/1992 Coll., on the Protection of nature and landscape, in the context of laws that amend the act.
