environmental migrants, legal protection, proposed solutionv českém jazyce - Environmentální migranti Cílem práce je analyzovat jak status quo, tak možný vývoj v oblasti environmentální migrace. Práce se skládá z pěti kapitol, přičemž každá z nich se zabývá různým aspektem environmentální migrace. První kapitola je úvodní a představuje historický vývoj konceptu environmentální migrace. Environmentální migrace není novým jevem. Přírodní a člověkem vyvolané katastrofy byly příčinou migrace již v minulosti a budou příčinou migrace i nadále. Tato kapitola se zabývá vztahem mezi migrací a životním prostředím a vede k vypracování hlavních příčin environmentální migrace. Druhá kapitola představuje nejčastěji používané pracovní definice environmentálních migrantů. Ačkoliv environmentální migrace byla v posledních letech předmětem živé diskuze odborníků, dosud neexistuje právně uznávaná definice environmentálního migranta. Třetí kapitola se zabývá právními předpisy týkajícími se environmentální migrace. Rozebírá uprchlické právo, právní normy týkající se bezdomovectví, mezinárodní humanitární právo, právo lidských práv a právo životního prostředí. Stávající právní úprava není dostatečně rozvinutá. in English - Environmental migrants The purpose of my thesis is to analyse both the status quo as well as the possible evolution of the policy framework of the environmental migration. The thesis is composed of five chapters, each of them dealing with different aspects of environmental migration. Chapter one is introductory and describes an overview of the historical content of environmental migration. Environmental migration is not a new phenomenon. Natural and human-made environmental disasters have caused migration of people in the past and continue to do so. This chapter addresses the linkage between environment and migration, which led to the elaboration of a typology of environmental migration. Chapter two characterises the most frequently used definitions of environmental migrants. Environmental migration has been the subject of lively debate in recent years but there is still no internationally agreed definition of environmental migrant. Chapter three examines relevant current legislation concerned to environmental migration. It discusses refugee law, statelessness, humanitarian law and human rights law.
