Problematika obětí domácího násilí - zejména její kriminologické a trestněprávní aspekty

Abstract

The aim of the thesis was to summarize the issue of the victims of domestic violence in the Czech Republic, including the legal development of the recent years, concerning particularly the criminological aspects of the issue as well as the criminal law aspects. The opening part deals with defining concepts such as domestic violence, victims, aggressors, their personal psychological aspects and legal terms - endangered person ("ohrožená osoba") and violent person ("násilná osoba"). The second main section of the thesis pays attention to the legislation on the help and support given to the victims of domestic violence in the Czech Republic, not only dealing with the immediate help given by the police and the judiciary in the form of the order-out decision of the aggressors from the common home, but dealing with the longterm psychological and social support offered by the intervention centers as well. The third basic part of the work focuses on the criminal law aspects of the domestic violence phenomenon, particularly current practice of the courts and rights of the victims as the aggrieved parties in the criminal procedure. Cílem této rigorózní práce bylo shrnout problematiku obětí domácího násilí v České republice z pohledu kriminologického a trestněprávního, na který je zaměřena stěžejní část této práce. V úvodní části práce je pozornost věnována popisu fenoménu domácího násilí, včetně vymezení pojmů domácího násilí, oběti a agresora, jejich osobnostních charakteristik, jakož i pojmu ohrožená a násilná osoba, jak je využíván v právní úpravě. Další část práce se zaměřuje na právní úpravu podpory poskytované obětem domácího násilí v České republice, a to nejen v oblasti bezprostřední pomoci obětem ze strany Policie ČR a justice formou vykázání násilné osoby ze společného obydlí, ale také dlouhodobější psychologické a sociální pomoci poskytované obětem prostřednictvím intervenčních center. Třetí stěžejní část této práce se zaměřuje na trestněprávní aspekty fenoménu domácího násilí, a to nejen z hmotněprávního hlediska, kde je věnována pozornost aktuální judikatuře, jež poskytuje výklad pojmům trestního zákoníku v této oblasti, ale také z pohledu procesních předpisů, zejména práv obětí domácího násilí v procesním postavení poškozených v rámci trestního řízení.
