Havárie v ochraně životního prostředí z pohledu práva

Abstract

This thesis deals with the major accidents in terms of legal regulation in the area of prevention, control and liquidation of consequences of major accidents. The first part defines the term "accident", and gives examples of the most serious accidents in the world. In the second part the thesis states sources of regulation of serious accidents in the international, European Union law and the Czech law. The focus of the work is in the third part, which defines basic elements of legislation in area of prevention of major accidents caused by chemicals in accordance with Act No. 56/2009 Coll., On the prevention of serious accidents caused by chemicals or chemical products and other related legislation from environmental protection. In the fourth part are summarized legal aspects of the control and disposal of major accidents in the Czech law, by mentioning the responsibilities of operatores of buildings and facilities in the event that disaster can not be averted, or that an accident has already occurred, further indicating the essential elements of the emergency legislation and commissioning of liability relations in issues dealing with the consequences of major accidents.

Diplomová práce se zabývá problematikou závažných havárií z hlediska platné právní úpravy v oblasti prevence, zdolávání a likvidace následků závažných havárií. V první části práce vymezuje pojem "havárie", a dále uvádí příklady nejzávažnějších havárií ve světě. Ve druhé části práce uvádí prameny právní úpravy závažných havárií, a to na poli mezinárodním, práva Evropské unie a českého práva. Těžiště práce je v části třetí, ve které jsou vymezeny základní prvky právní úpravy prevence závažných havárií způsobených vybranými chemickými látkami dle zákona č. 56/2009 Sb., o prevenci závažných havárií způsobených vybranými chemickými látkami nebo chemickými přípravky a dále dalších souvisejících právních předpisů z oblasti ochrany životního prostředí. V části čtvrté jsou shrnuty právní aspekty zdolávání a likvidace následků závažných havárií v rámci českého práva, a to uvedením povinností provozovatelů objektů a zařízení pro případ, že havárii nelze odvrátit, popřípadě, že k havárii již došlo, dále uvedením základních prvků krizové legislativy a uvedením jednotlivých odpovědnostních vztahů v otázkách vypořádávání se s následky závažných havárií.
