Child civilian International protection Child soldiers5 RESUMÉ Pravidla upravující ochranu dětí v ozbrojeném konfliktu prošla za posledních několik let rozsáhlým vývojem. Od 30. let 20. století, kdy se začaly tvořit první mezinárodní instrumenty sloužící k uznání dětí jako specifické skupiny, která vyžaduje větší pozornost a zvláštní přístup, přes vrchol rozkvětu v 90. letech, kdy byla dětem věnována závazná Úmluva o právech dítěte a dětská ochrana se stala klíčovou otázkou pro mnoho mezinárodních aktérů až do počátku 21. století, ve kterém se již pozornost nesoustředí na zakrývání mezer v formálně právní části, ale naopak se ochrana dítěte začíná směřovat k vyrovnání rovnováhy mezi přijatými závazky a jejich realizací. Dítěti je dnes věnováno mnoho dokumentů mezinárodní povahy, avšak jejich aplikace a provádění v mnoha ohledech zaostává. Ozbrojené konflikty v dnešní době již nemají výhradně mezinárodní povahu a normy, které dříve upravovaly jen vztahy mezi státy, se dnes musí přizpůsobit jejich novému charakteru. Smíšené a vnitrostátní konflikty převažují a v nich se objevuje i čím dál větší zaměření pozornosti na civilní obyvatelstvo včetně dětí jako snadných cílů násilí. V této situaci jsou děti zvláště ohrožené z mnoha důvodů. Jednak mnoho z nich žije na hranici chudoby a účast, ať již jakékoli podoby v ozbrojeném konfliktu, jim dovoluje uspokojit...
5 ABSTRACT The rules governing the protection of children in armed conflicts has undergone an extensive evolution over the last few years. From the beginning of 20th century when the first international instruments for acknowledging children as a specific group requiring better attention and a special approach started to form, through the boom in the 1980 when the binding Convention on the rights of the child was dedicated solely to children and children's protection became the key question for many international participants, till the 21th century where the protection of children began to be oriented towards the balance between accepted obligations and their realization. Today, many international documents deal with the protection of children; however, their implementation and realization is often lacking. Armed conflicts are no longer of a traditional international character today and the norms, which dealt with relations between states, are no longer valid and need to be reassessed. Mixed and internal armed conflicts prevail and the attention is focused on civilian children included as an easy targets.
