Nedobrovolné přijetí na psychiatrii

Abstract

The translated thesis deals with the topic of admission to psychiatry departments without the patient consent, which is a so called involuntary admission and involuntary treatment. The teoretical part mentions briefly how social and ethic norms leading to the creation and respecting patient rights have been developing. Basic documents establishing patient rights are indicated, including the right to accept or refuse treatment. Next, there is a description of the history of psychiatry hospitalization without the patient consent and the development of legal rules in the field of involuntary hospitalization. The following chapters are concerned with the incidence of involuntary admission cases. Descriptions of elementary terms referring to the informed consent and hospitalization without patient consent can be found as well. The applied part is focused on a more delailed analysis of some rules of law. It mainly compares Convention on Biomedicine with existing national legislation and deals with the application of the regulations resulting from the Convention on Biomedicine into routine. Předkládána magisterská práce zpracovává téma přijetí a hospitalizace na psychiatrii bez souhlasu pacienta, tzv. nedobrovolný vstup a nedobrovolnou léčbu. Teoretická část práce uvádí ve stručnosti vývoj společenských a etických norem vedoucích k tvorbě a respektování práv pacientů a stěžejní dokumenty určující práva pacientů, kam spadá i právo na souhlas s léčbou, popřípadě odmítnutí léčby. Dále popisuje historii psychiatrických hospitalizací bez souhlasu nemocného a vývoj právních norem v oblasti nedobrovolných hospitalizací. Navazující kapitoly se zabývají incidencí nedobrovolných vstupů a popisem základních termínů v oblasti informovaného souhlasu a hospitalizace bez souhlasu pacienta. Praktická část je zaměřena na podrobnější rozbor některých právních norem, zejména na srovnání Konvence o biomedicíně a stávající národní legislativy a na aplikaci ustanovení vyplývající z Konvence o biomedicíně do praxe. S tématem přijetí a léčby bez souhlasu souvisí i problematika informovaného souhlasu a způsobilosti k právním úkonům, práce zasahuje i do oblasti práv pacientů a vztahu zdravotníka a pacienta. Závěrečná část obsahuje návrh doporučení, diskusi a závěr. Uplatňování pravidel daných Konvencí o biomedicíně bude vyžadovat změny v našem medicínském právu i v praxi zdravotnických zařízení, přinese i...
