Tématem této práce je problematika jednorázového odškodnění bolesti a ztížení společenského uplatnění v českém právním řádu, zejména ve Vyhlášce Ministerstva zdravotnictví č. 440/2001Sb., v platném Občanském zákoníku (zákon č. 40/1964Sb.) a v novém Občanském zákoníku (zákon č. 89/2012Sb.). Cílem mé práce bylo shrnout existující právní úpravu na pozadí judikatury Nejvyššího soudu ČR a porovnat ji s právní úpravou, která bude účinná s účinností nového Občanského zákoníku od roku 2014. Zabývala jsem se obecně odpovědností za škodu a konkrétně odpovědností za škodu na zdraví, zejména jejím odškodňováním; vznikem, zánikem a promlčením nároku na náhradu škody na zdraví; procesem hodnocení rozsahu škody na zdraví a jeho nedostatky. Součástí práce je také exkurz do procesního hlediska souvisejícího s uplatňováním daného nároku, do Principů evropského deliktního práva (PETL), do nového Občanského zákoníku a bohaté judikatury Nejvyššího soudu ČR.
The purpose of my thesis is to analyze the legal regulation of legal responsibility for damages and compensation for damages, with special concern for health damages (damage to health). In the very near future, the biggest change in Czech civil law will come, and the comparison between contemporary legislation and the future legislation is also the reason for my research. The thesis consists of 12 chapters including introduction and conclusion. Each chapter is dedicated to partial institutes of the regulation or to institutes connected with this regulation.
