Abstract

Téma diplomové práce "P ímá volba prezidenta eské republiky" autor zvolil s ohledem na aktuálnost tohoto tématu. Dalo se o ekávat, že b hem zpracování práce dojde jak k p ijetí provád cího zákona, tak i k samotné první p ímé volb prezidenta republiky. Cílem práce je poskytnout co nejkomplexn jší pohled na právní úpravu volby hlavy státu, shrnout teoretická východiska, provést analýzu pr hu legislativního procesu a pokusit se o navržení možných zm n. Práce je rozd lena do p ti kapitol. Kapitola první popisuje obecn pojem "hlava státu" a zam uje se na zp sob její volby v republikách. Ve druhé kapitole se autor rámcov v nuje postavení a pravomocím prezidenta dle Ústavy R. T etí kapitola se zabývá historickým vývojem právní úpravy volby prezidenta republiky. V našich podmínkách m la historickou tradici volba parlamentní, z tohoto d vodu autor provádí analýzu volby prezidenta v jednotlivých ústavách od roku 1918. tvrtá kapitola je rozd lena do t í ástí a obsahuje jednotlivé návrhy ústavních zákon zavád jících p ímou volbu. V první podkapitole jsou uvedeny návrhy ústavních zákon , které byly p edloženy p ed vznikem Ústavy R. Druhá podkapitola se zabývá návrhy ústavních zákon vyskytujících se po roce 2001 a v záv ru této kapitoly autor p edstavuje všechny argumenty pro a proti zavedení p ímé volby...

The theme of the Thesis "The Direct Election of the President of the Czech Republic" has been chosen by its author with regard to the currency of this topic. It could have been expected that during the formulation of this Thesis the adoption of the Implementing Act, as well as the very first direct presidential elections, is held. The aim of the Thesis is to provide the most comprehensive view of regulation of presidential election, to summarize theoretical basis, to analyse the legislative procedure and to try to suggest possible amendments. The Thesis is composed of five chapters. Chapter One introduces generally the term "Head of State" and defines the way of its election in different republics. In the Second Chapter, the author generally deals with the role and powers of the president according to the Constitution of the Czech Republic. The Third Chapter addresses the historical development of presidential election legislation. The Parliamentary election had a long historical tradition in our country, which is the reason why the author analyses the presidential elections in the various constitutions since 1918.
