Trestněprávní aspekty sexuálního zneužívání

Abstract

předkládaná disertační práce se věnuje trestněprávním aspektům sexuálního zneužívání, neboť jde o problematiku citlivě vnímanou a stále aktuální. Předpokládá se, že významná menšina dětí v Evropě (10 až 20 %) je během svého dětství vystavena sexuálnímu zneužití. Jedná se tak o nezanedbatelné číslo, na které je třeba reagovat hledáním odpovědí na otázky, jak nejlépe ochránit dítě před takovým zneužitím a jak nejlépe zabránit potenciálnímu pachateli, aby dítě zneužil. Za nejúčinnější nástroj v potírání tohoto závažného jevu je považováno trestní právo, a proto si tato práce klade za cíl rozebrat téma sexuálního zneužívání z pohledu trestního práva po hmotné i procesní stránce, poukázat na nedostatky platné právní úpravy a pro futuro doporučit možná řešení. Obsah práce tvoří historický exkurz, úvod do problematiky sexuálního zneužívání a vymezení základních pojmů (vývoj poznávání a současná situace, příčiny a formy, základní charakteristika obětí a pachatelů, následky sexuálního zneužívání a výskyt a prevalence tohoto fenoménu včetně grafického znázornění), formy prevence v oblasti sexuálního zneužívání na primární, sekundární a terciární úrovni, problematika komerčního sexuálního zneužívání (dětská prostituce, dětská pornografie a obchodování s dětmi pro sexuální účely), právní úprava sexuálního...

This thesis deals with the criminal aspects of sexual abuse as it is a very sensitively perceived and always current issue. It is assumed that a significant minority of children in Europe (10-20 %) is sexually abused during their childhood. It is not an insignificant number and it is necessary to react with searching for answers to questions about how best to protect the child from such abuse and how best to prevent a potential offender from abusing a child. The most effective tool in combating this serious phenomenon is considered criminal law, and therefore the aim of this paper is to analyse the topic of sexual abuse in terms of the substantive and procedural criminal law, to point out the shortcomings of current legislation and recommend possible solutions.
