the crime of murder investigation crime scene investigationTématem mé diplomové práce je metodika vyšetřování vražd. V práci jsem se zabývala kriminalistickými stopami vytvářenými při spáchání trestného činu vraždy, typickými vyšetřovacími situacemi, kterým musí odpovídat specifická činnost kriminalistů a některými následnými úkony. Cílem diplomové práce je seznámení s trestným činem vraždy a specifiky jeho vyšetřování, shrnutí poznatků získaných studiem odborných monografií, článků v odborných časopisech a některých soudních rozhodnutí, dále nastínění vybraných otázek a poukázání na možné problémy. Diplomová práce se skládá z pěti kapitol, které jsou dále členěny do podkapitol. Po úvodních slovech následuje první kapitola popisující vraždu z trestněprávního hlediska, zmiňuje se o vraždě prosté a spáchané s rozmyslem či po předchozím uvážení, o právní úpravě trestného činu zabití a o pojetí vraždy v anglickém trestním právu. Druhá kapitola charakterizuje jednotlivé prvky kriminalistické charakteristiky trestného činu vraždy a obsahuje zhodnocení rozpracování problematiky vyšetřování vražd v odborné literatuře. Třetí kapitola se týká kriminalistických stop vytvářených při páchání vražd, je zaměřena na problematiku biologických stop a s těmito související Národní databázi DNA, věnuje se pachovým stopám a problematice uznání pachových stop jako důkazu v...
The topic of my thesis is the methodology of murder investigation. The thesis deals with trace evidence formed during commission of the crime of murder, typical investigative situations faced by crime investigators, and some of the subsequent acts. The aim of this thesis is to familiarize with the offense of murder and the specifics of crime scene investigation. Furthermore, this work provides a summary of the knowledge obtained through the study of monographs, articles in professional journals, and some of the court relevant decisions. Finally, the work further outlines some selected questions and points out the potential problems related to crime scene investigation. The thesis consists of five chapters, which are further divided in to subchapters. Following the introduction, the first chapter describes the murder under criminal law and outlines the various classifications of murder, which include plain murder, murder committed with forethought or prior consideration, and manslaughter. Moreover, the chapter discusses the legislation pertinent to the concept of murder, and explores its roots under the criminal law of England and Wales.
