Volební právo cizinců v komunálních volbách České republiky a jeho využití

Abstract

Diploma thesis sets itself a task to evaluate the using of voting right by foreign nationals in local elections in the Czech Republic. The thesis shows the approach of other member states of European Union to the voting right of foreign nationals in local elections, the legislative framework and the legal position of foreign nationals in the Czech Republic. The centre point of the thesis lies in the real experience of the foreign nationals and mayors or workers of municipal authorities with voting right in the local elections. Information gained during the research allows to study the practice of voting right. During the research there were discovered reasons why the foreign nationals participate or not in local elections. There were explained opinions of foreign nationals about the quality of information of their possibility to participate in local elections and about the conditions of voting right declared by state. Opinions and ideas of foreign nationals are compared with the opinions and experience of mayors or workers of municipal authorities and state institutions.

Diplomová práce si klade za cíl zhodnocení využívání volebního práva cizinci ve volbách do zastupitelstev obcí v České republice. Práce poukazuje na přístup ostatních členských států Evropské unie k možnosti výkonu volebního práva cizinců ve volbách do zastupitelstev obcí, na legislativní vymezení této možnosti a samotné právní postavení cizinců v České republice. Stěžejní část pak spočívá v osobních zkušenostech vybraných cizinců a starostů či pracovníků městských úřadů s výkonem volebního práva ve volbách do zastupitelstev obcí. Informace získané během výzkumného šetření umožňují představení skutečné praxe týkající se výkonu volebního práva cizinců. Odkrývají důvody, které cizince vedou či naopak odrazují od aktivní účasti ve volbách, přinášejí názory na úroveň informovanosti cizinců o možnosti volebního práva i na státem stanovené podmínky pro jeho samotné přiznání. Názory a postřehy cizinců jsou konfrontovány s názory starostů a pracovníků městských úřadů i příslušných státních institucí.
