Zákonodárná činnost českého zemského sněmu od roku 1627 do roku 1848

Abstract

The basic goal of this work is to present a general picture of the real as well as formal powers and proceedings of the Bohemian Assembly by analyzing its particular decrees. This procedure allows for defining areas, where we can encounter the actual exercise of legislative competences of the Bohemian Assembly. The basic source for defining and delimitating areas of real legislative competences is the text of the Renewed Constitution. There were different areas accessible for regulations. Based on the analysis of the other particular decrees, it seems that the classes of Bohemian Assembly had enough confidence to act independently in the accessible areas of regulations.

Základním cílem této práce bylo vytvořit analýzou jednotlivých usnesení celkový obraz o skutečné i formální činnosti (pravomoci) českých zemských sněmů a sjezdů. Touto cestou jsou pak definovány oblasti, ve kterých stavové z hlediska své zákonodárné pravomoci působili. Základním pramenem pro definování a vymezení pravomocí je text Obnoveného zřízení zemského. Z této práce vyplývá, že české stavy měly i v době absolutismu svůj nezastupitelný význam při spravování země a vydávání důležitých zákonných norem. Z rozličných oblastí, jejichž úpravou se jednotlivé sněmy popř. sjezdy zabývaly, je vidět, že jim byly otevřeny rozličné obory.
