Abstract

The rigorous thesis is focused on license agreement and employee work. The aim of the thesis is not only an analysis of the use of a copyrighted work by a person different from the author of the work, but also an analysis of the performance of copyright by a person different from the author of the work. The thesis consists of five chapters. The opening chapter provides a summary of the notion of copyright, its sources at the national and international levels, but also the European Union legislation and the object of the Copyright Act. Chapter two explains the concept of copyrighted work, concerns the author of a work and categorizes the object of protection in terms of various types. Chapter three deals with the moment of emergence of copyright with respect to a work and with the division of the rights of the author on personal rights and proprietary rights. The core of the thesis is not only in chapter four analyzing the license agreement, but also in chapter five dealing with the issue of employee work. Chapter four describes in detail the license as a copyright relationship, and the standard copyright license agreement including its subjects, elements and form as a legal act. Rigorózní práce se zaměřuje na téma licenční smlouva a zaměstnanecké dílo. Cílem práce je nejenom rozbor užití autorského díla jiným subjektem, než je samotný autor díla, ale rovněž i výkon autorského práva osobou odlišnou od autora. Práce je celkem členěna do pěti kapitol. V úvodní kapitole je shrnutý pojem autorského práva, jeho prameny v rovině národní, mezinárodní, ale i prameny práva Evropské unie, včetně předmětu úpravy autorského zákona. Druhá kapitola vysvětluje pojem autorské dílo, kdo je autorem díla, a rozděluje předmět ochrany podle druhů. Třetí kapitola se věnuje okamžiku vzniku autorského práva k dílu, rozdělení práv autora na práva osobnostní a práva majetková. Stěžejní je jak kapitola čtvrtá, rozebírající licenční smlouvu, tak i kapitola pátá, věnovaná problematice zaměstnaneckého díla. Ve čtvrté kapitole je podrobně popsána licence jako vztah autorskoprávní, typová autorskoprávní licenční smlouva včetně jejich subjektů, náležitostí a formy právního úkonu. Součástí této kapitoly je analýza formy právního úkonu, užití díla nabyvatelem licence, dispozice s licencí, vysvětlení pojmu podlicence a postoupení licence, ujednání o odměně a rozsah licence.
