Euthanasie a trestní právo

Abstract

1 Abstract Euthanasia is a highly controversial issue that is becoming an increasingly hot topic almost all over the world. Etymologically, the word "euthanasia" has its origins in the Greek word "euthanatos", meaning "good death" (from eu- "good, pleasant" + thanatos "death"). Later, however, in the wake of an interpretative shift, euthanasia generally came to be used, alongside its meaning of good death (merciful, good, beautiful, easy death), as the term of choice in connection with killing out of pity or compassion. Although, in my thesis, I discuss the subject of "good death" primarily from the perspective of criminal law in force in this country, the issue of euthanasia is very broad and encompasses not only criminal law or law in general, but also extends into a wide range of social fields. For this reason, in my thesis I also touch on euthanasia's relationship with medicine and religion, abuse of the concept of euthanasia and, not least, on legislation in other countries. The brief introduction to the thesis centres on an explanation of my motivation for choosing this subject and outlines what I will discuss in more detail in the main body of text. 1 Resumé Problematika euthanasie je velice kontroversním a stále častěji diskutovaným tématem téměř po celém světě. Etymologický význam slova euthanasie pochází z řeckého slova ,,euthanatos" a v překladu znamená "dobrá smrt". Jde o spojení slov ,,eu" (dobrý, příjemný) a ,,thanatos" (smrt). Později však došlo k interpretačnímu posunu a termínem euthanasie se nejčastěji rozumí jednak ona dobrá smrt (milosrdná, dobrá, krásná, lehká smrt) a jednak se tento termín užívá v souvislosti s usmrcením z útrpnosti či soucitu. Ve své práci pojednávám o tématu dobré smrti především z hlediska platného trestního práva na našem území. Nicméně problematika euthanasie je velmi široká a netýká se pouze trestního práva či práva obecně, ale zasahuje do celé škály společenských oborů. Z tohoto důvodu se ve své práci okrajově věnuji i vztahu euthanasie a zdravotnictví, náboženství, zneužití pojmu euthanasie a v neposlední řadě také její právní úpravě v zahraničí. Stručný úvod rigorózní práce vysvětluje především mou motivaci k výběru daného tématu a dále nastiňuje, čemu se budu v práci podrobněji věnovat. V úvodní kapitole se zabývám nejprve vývojem pojmu euthanasie a následně i jejími formami. V návaznosti na definice významných odborníků se snažím zejména jednoznačně vymezit jednotlivé formy euthanasie pro potřebu této práce....
