Trestněprávní prostředky boje s organizovaným zločinem

Abstract

Předkládaná disertační práce se věnuje trestněprávním prostředkům v boji s organizovaným zločinem. Organizovaný zločin patří v posledních letech bezesporu k jednomu z nejzávažnějších problémů, se kterými se musí jednotlivé státy, včetně České republiky, účinně vypořádat, a to zejména na poli legislativním. V podmínkách naší republiky se tento fenomén výraznějším způsobem začal projevovat až po pádu totalitního režimu, kdy společně s otevřením hranic došlo i k rozmachu činnosti nejprve zahraničních zločineckých organizací a následně pak i tuzemských. České zákonodárství však zpočátku nijak výrazněji na nově vzniklou situaci nereagovalo a tím ponechalo volný prostor pro snadnější etablování organizovaného zločinu na našem území. Teprve se stále výrazněji se ozývajícími se hlasy, které volaly po náležité reakci na vzniklou situaci, došlo na legislativní úrovni k několika více či méně zásadním změnám a tato situace přetrvává až do dnešního dne. Při potírání organizovaného zločinu se jeví být nejúčinnějšími prostředky trestního práva, a to nejen práva hmotného, ale i procesního. Presented dissertation is devoted to the criminal means of dealing with organized crime. Recently the organized crime has undoubtedly belonged to the category of most serious problems that the individual countries, including the Czech Republic, have had to cope with especially in the field of legislature. In our country this phenomenon became more visible after the fall of the totalitarian regime when the borders were opened. This resulted in the boost in the activity of foreign criminal societies and domestic criminal societies consequently. However, at the beginning the Czech legislature did not take any serious action thus providing free space for the organized crime to establish itself in the Czech Republic. It was the intensive calls for an action that would react to the current situation which spurred the legislature to make several more or less crucial changes prevailing up to now. When dealing with the organized crime, the tools of criminal substantive as well as procedural law appear to be the most effective ones.
