Abstract

79 Abstrakt Cílem této práce je popsat jednotlivé způsoby užití díla v oblasti internetu a způsob jejich ochrany v tomto specifickém prostředí. Jedná se o vysoce aktuální téma, neboť internet výrazně zasahuje do každodenního života dnešní společnosti a ovlivňuje tak i další vývoj právního řádu. Práce je rozdělena do čtyř kapitol. První se věnuje obecně pojmům internet a autorské právo a je zde zachycen vývoj této oblasti soukromého práva na území samostatné České republiky, včetně uvedení pramenů vnitrostátních a mezinárodních. Druhá kapitola definuje autorské dílo, jeho jednotlivé druhy dle autorského zákoníku, osobu autora, užití díla ať již formou smluvní, nebo mimosmluvní a též důležité zpřístupnění díla prostřednictvím internetu. Ve třetí kapitole se autor zaměřuje na ochranu autorských práv v soukromoprávní i veřejnoprávní sféře a technické prostředky ochrany (DRM). Poslední, a z hlediska pojednávaného tématu nejdůležitější, čtvrtá kapitola obsahuje jednotlivé způsoby užití díla prostřednictvím internetu včetně jejich detailního popisu. 80 Abstract The aim of this thesis is to describe various ways of use of works on the Internet and method of their copyright protection in this specific environment. Because without any doubt the Internet interferes with everyday life of today's society and subsequently has a significant effect on further development of a legal system, this topic becomes very relevant. The thesis itself is divided into four chapters. The first chapter is devoted to general description of the Internet and copyright law, and contains explanation of development of this private law area in the territory of the independent Czech Republic, including list of national and international legal sources. The second chapter defines the copyrighted work and its different types according to the Czech Copyright Act, an individual author, use of the work, whether in the form of a contractual or non-contractual disclosure and also important topic of making the work available through the Internet. The third chapter analyzes the copyright protection in the private and public spheres, and technical means of such protection (DRM). The last, and with respect to the discussed topic the most important, fourth chapter deals with various ways of use of works on the Internet, including their detailed description.
