distance contract, consumerSmlouvy uzavírané na dálku (tzv. distanční smlouvy) jsou jedním ze dvou typů spotřebitelských smluv výslovně upravených občanským zákoníkem (druhým typem jsou smlouvy sjednávané mimo provozovnu, tzv. podomní obchody). Spotřebitelské smlouvy nejsou novým smluvním typem, jedná se pouze o speciální pojmenování klasických smluv (např. o koupi, o dílo), pro něž je charakteristické, že jsou uzavírány mezi spotřebitelem a dodavatelem. Pro účely spotřebitelských smluv je dodavatelem osoba jednající v rámci své obchodní nebo podnikatelské činnosti, naproti tomu spotřebitelem se rozumí osoba, která při uzavírání a plnění smlouvy nejedná v rámci obchodní nebo podnikatelské činnosti. Právě potřeba chránit ve zvýšené míře spotřebitele, jakožto slabší stranu smluvního vztahu, vedla k zařazení dosud neznámého institutu spotřebitelských smluv do právní úpravy. To bylo realizováno zákonem č. 367/2000 Sb., jehož prostřednictvím se do našeho právního řádu promítly 3 směrnice ES, a to směrnice Rady 93/13/EHS o nepřiměřených podmínkách ve spotřebitelských smlouvách, směrnice Rady 85/577/EHS o ochraně spotřebitele v případě smluv uzavřených mimo obchodní prostory a směrnice Evropského parlamentu a Rady 97/7/ES o ochraně spotřebitele v případě smluv uzavřených na dálku. The agreements concluded by means of distant communication ("distance contracts") are one of the two types of Consumer Agreements explicitly defined by the Civil Code (the other type being agreements concluded outside usual business premises, "door-to-door contracts"). Consumer Agreements are not a stand-alone contractual type, but merely a specific term for those traditional contractual types (e.g. purchase agreement, agreement for work) concluded between a consumer and a supplier. For the purposes of Consumer Agreements, the supplier is defined as a person acting in the framework of his trade or other business activity, while the consumer is on the contrary a person who doesn't act in the framework of his trade or other business activity. It was the need to establish the higher standard of protection towards consumers (as a weaker contractual party) that led to the introduction of the new instrument of Consumer Agreements into the legal framework.
