Právní ochrana průmyslových vzorů

Abstract

Tato rigorózní práce pojednává o právní ochraně poskytované průmyslovým vzorům na území České republiky od jejich počátků až po současnost. Zaměřuje se na odlišnosti současné právní úpravy ochrany průmyslových vzorů od dřívějších právních úprav. Těžištěm práce je právní úprava vzniku, trvání a zániku právní ochrany zapsaného průmyslového vzoru. Práce pojednává také o různých aspektech spojených s problematikou práva na ochranu průmyslových vzorů převážně s ohledem na současnou právní úpravu, jimiž jsou zejména práva plynoucí ze zapsaného průmyslového vzoru, omezení těchto práv a jejich vyčerpání či právní prostředky ochrany práv, které ze zapsaného průmyslového vzoru plynou. Rigorózní práce se také zabývá rozdíly ochrany výrobku mezi právem na ochranu průmyslových vzorů a autorským právem. Součást práce tvoří i mezinárodní ochrana průmyslových vzorů a ochrana průmyslových vzorů v rámci Evropské unie. V této práci jsou zohledněny i některé případy z judikatury Soudního dvora Evropské unie ve věcech průmyslových vzorů a rovněž tak i z judikatury národní.

This thesis deals with the legal protection granted to the industrial designs on the area of the Czech Republic since its beginning till the present time. It focuses on the differences of the present legal regulation of protection of industrial desings from the previous legal regulations. The core issue of the thesis is the legal regulation of beginning, continuance and expiration of the legal protection of an enlisted industrial design. It also deals with the various aspects connected with other problems of the right to protection of industrial designs from the point of view of the present legal regualation such as the rights arising from the enlisted industrial design, limitation of these rights and their expiration or legal means to protect the rights arising from the enlisted industrial design. The thesis deals also with the differences in the field of protection of a product according to the law on protection of industrial desings and on protection of authorship. A particular part of the thesis focuses on the international protection of industrial designs and on the protection of industrial designs in the framework of the European Union.
