Závěr Před tvůrci právních předpisů České republiky, zemí Evropské unie, ale i celého světa stojí v současné době, tedy v době bezprostředně následující po finanční a hospodářské krizi, výzva v podobě zabezpečení, aby podobná krize opět nenastala ze stejných příčin. Otázkou je, co bylo příčinou. Na bankovní byznys je ale v této souvislosti často upozorňováno v souvislosti s nedodržováním pravidel obezřetnosti, hlavně v USA, z riskantního poskytování zejména hypotéčních úvěru, z hamižného, bezohledného chování jejich přepláceného managementu a na následné astronomické prostředky vynaložené na sanaci bankovního sektoru. Je zřejmé, že další úprava bankovnictví půjde cestou dalšího zpřísňování požadavků, zejména na kapitálové zabezpečení bank. Je totiž otázkou, do jaké míry bankovní regulace ochraňuje spotřebitele a potom státy nucené následně investovat do eventuální záchrany a do jaké míry naopak podvazuje a omezuje podnikání bank a tím i subjektů, které k podnikání potřebují úvěry a investice bank, čímž podvazuje hospodářský růst. Uvědomme si, že západní civilizace čelí a bude čelit rostoucímu tlaku rozvíjejících se ekonomik východu a přílišná regulace může být zásadní brzdou pro naši již tak vadnoucí konkurenceschopnost. Bank as a Commercial Company The main aim of the diploma work "Bank as a Commercial Company"is to show a bank from a view of the company law. Its objective is not to describe all bank institutes, but to show some differences between legal regulation of joint-stock companies and banks in Czech legal regulation and to describe these differences. This aim is fulfilled by comparing the Act No. 21/1992 Coll. as subsequently amended (hereinafter referred to as the "Bank Act") with regulation of joint-stock companies established by Act. No. 513/1991 Coll., Commercial Code as subsequently amended and with some other Acts related to companies. Banks are generally traders with money. Bank Act characterizes bank as a legal entity residing in the Czech Republic, established as joint-stock company that accepts deposits and provide loans and which have a licence for exercising abovementioned business. The special role and other special characteristics of bank business create the necessity of a special legal regulation. Main aims of such legal regulation are to protect deposits of depositors, to ensure stability of banks and whole the financial sector.
