Záver Zvolená téma práce poskytovala viacero možností spracovania. Internet už zďaleka nie je neznámym, zriedka dostupným médiom, ale neoddeliteľnou súčasťou bežného života. Preto už úvod práce nie je venovaný tradičnému popisu technických otázok jeho fungovania, ale skôr zamysleniu nad jeho špecifikami a dôvodmi pre právnu úpravu ním umožnených úkonov. Využívanie prevažne zahraničných zdrojov informácií motivované snahou o obohatenie práce pohľadom z iného právneho prostredia napomáhalo naplnenie cieľa tejto práce spočívajúceho v poskytnutí nie úplne tradičného pohľadu na vybrané otázky vzťahu medzinárodného práva súkromného a internetového obchodovania. Z troch základných otázok medzinárodného práva súkromného- určenia príslušnosti súdu, uznávania a výkonu súdnych rozhodnutí a určenia rozhodného práva, je práca zameraná predovšetkým na tretiu z nich. Rozhodné právo môže byť určené na základe kolíznych noriem (tak je to väčšinou v predpisoch európskeho práva záväzných aj v jednotlivých členských štátoch) alebo je obsiahnuté v norme priamej. Ich odlíšeniu je venovaná časť druhej kapitoly a následne sú bližšie analyzované jednotlivé relevantné právne predpisy. Metóda priamej úpravy sa uplatňuje v dohovoroch medzinárodného práva a je z viacerých rôznych dôvodov sporadickejšie využívanou metódou úpravy vzťahov...
Internet business transactions with an international element The purpose of this thesis is to analyse particular issues arising out of cross-border business transactions conducted over the internet from perspective of private international law. It is mainly focused on the law applicable to contractual obligations in such transactions. The thesis consists of introduction, five chapters and conclusion. First chapter explains the concept of internet business transactions, describes different kinds of them and most importantly, shifts the focus from the traditional description of technical aspects of internet functioning to concept of internet governance, its reasons and different opinions on the need of rules designed for internet. Chapter Two begins with the definition of an international element. That is followed by characterizing the two basic methods used for regulation of the contractual relationships in private international law. Chapter Three is concerned with the rules of European private international law. It is divided into three subchapters, which are related to regulations Rome I, Rome II and the Directive 2000/31 on e-commerce respectively.
