Nový legislativní rámec Evropské unie pro oblast technické regulace a harmonizace

Abstract

Závěr Právní předpisy tvořící "Nový legislativní rámec" byly přijaty jako výsledek revize uplatňování principů a instrumentů "Nového přístupu" při tvorbě a aplikaci harmonizačních právních předpisů pro oblast technických požadavků na výrobky a podmínek jejich uvádění na trh. Přičemž cílem nebylo osvědčený a dobře fungující "Nový přístup" nahradit, ale naopak ho zlepšit a zdokonalit. Odborná literatura se zatím problematice "Nového legislativního rámce" nikterak podrobně nevěnovala, a proto jsem nucen své závěry odvíjet především od dílčích podnětů získaných od věcných odborníků napříč celým oborem, které jsem pochytil během své práce v Úřadu pro technickou normalizaci, metrologii a státní zkušebnictví, a od obecné právní logiky, kterou bylo třeba mnohdy použít k zpřesnění či korekci jejich názorů. Při posouzení celého "Nového legislativního rámce" je nutné konstatovat, že každý jeho jednotlivý právní předpis se zaměřil na svou jasně vymezenou oblast, s tím, že se jejich působnosti nepřekrývají, ale doplňují, a přitom v zásadě postihují kompletně téměř celou oblast technické regulace a harmonizace. The New Legislative Framework of European Union for the technical regulation and harmonization Resume: One of the basements of the European Communities is the freedom of free movement of goods between Member States and with this freedom related successive construction of the internal market. Obstacles to the filling of this freedom occurred since the establishment of the European Communities, often based on a technical level. Competent authorities in each Member State were applying its own technical requirements on products, which were very often quite different. As a one of the ways for removing this obstacles was formed the harmonization of a technical regulation. The first stage of the harmonization was called the Old Approach, which was very detailed and by its form very similar to a technical standards. This is the moment from which we can distinguish in the technical regulation between the harmonized and non-harmonized sphere. It means whether is the regulation made by a Member State or by a Community. In the eighties of 20th century the European Community formed a new system, which goal was to harmonize technical requirements on products more flexibly. This system was called the New Approach.
