Abstract

62 IV. ZÁV R Smlouva o Antarktid , která dala vzniknout jedine nému smluvnímu systému, byla p ijata v roce 1959. Jde o výjime nou mezinárodní smlouvu, na jejímž základ došlo k p ijetí dalších mezinárodních smluv, které tvo í Antarktický smluvní systém a zajiš ují ochranu nám tolik vzdáleného kontinentu. V roce 2009, tedy 50 let po p ijetí Smlouvy, se m žeme krátce ohlédnout zp t a p ipomenout mezinárodní situaci na konci 50. let. Je totiž až neuv itelné, nakolik státy byly schopny sjednotit své rozdílné názory, vzdát se tvrzených územních nárok a spolupracovat na vytvo ení Antarktidy jako oblasti zasv cené míru a v d , území, jež je demilitarizované a denuklearizované. Byly schopny ustoupit ze svých politických vizí a p edejít ozbrojenému konfliktu, od kterého v dob zvyšujícího se zájmu o Antarktidu a o její nerostné bohatství, nebylo daleko. Jaká byla mezinárodn politická situace na konci 50. let? Sv t se vzpamatovával z konce druhé sv tové války. Probíhala studená válka mezi Sov tským svazem a Spojenými státy. Na Kub se Fidel Castro ujal vlády. Aljaška se stala 49. státem USA. A byla podepsána Smlouva o Antarktid . Tato Smlouva se bezesporu stala jedine nou mezinárodní dohodou, která již 50 let ú inn zajiš uje ochranu Antarktidy. Jak se uvádí, jde o velice "elegantní" mezinárodní dokument - celá Smlouva...

73 ENGLISH SUMMARY Environmental Protection in Anarctica The main goal of my thesis is to describe and explain the legal structure and guaranteed environmental protection of the last continent. I want to deal with the very special legal system that governs Antarctica and is possible only because of the consensus of states that declared their territotial claims to this continent. My paper is devided into three main parts, namely, Introduction to Antarctica, The Antarctic Treaty System, The Protocol on Environmental Protection to the Antarctic Treaty, and The Czech Republic and the Antarctica. 1. Introduction to Antarctica I devoted the first part of my thesis to introducing the last continent and its special features. I mentioned the evolution of the continent, the first men who explored Antarctica, its climate, fauna and flora in the area covered by the Antarctic Treaty. I also included tourism and the growing number of visitors to Antarctica every year. 2. Antarctic Treaty System The roots of the special legal regime and the protection of the Antarctic environment are based on the Antarctic Treaty concluded in Washington, DC, in 1959.
