Abstract

87 Execution of alternative punishments - Resumé The purpose of my thesis is to describe a process of an execution of alternative sanctions and the biggest problems in this part of criminal proceeding. This thesis is divided into seven chapters: Term of punishment and its purpose, Execution of punishments as a specific part of criminal proceeding, Alternative sanctions, Community service, Suspended sentence, Pecuniary punishment and House arrest. The first two chapters deal with the term of punishment and its execution in a general sense. The third chapter concentrates on alternative sanctions, their definition, evolution, purpose and advantages. Next three chapters describe specific alternative sanctions which the Czech penal code lists: community service (an offender is sentenced to do an unpaid work in his free time in a local community), suspended sentence (the criminal is not sent to prison but he is obliged to behave well for a fixed period of time, it can be imposed along with various duties and restrictions or with a supervision of probation officer) and pecuniary punishment (the criminal is sentenced to pay specific amount of money to the state). Cílem bylo v p edkládané práci na rtnout problematiku alternativních trest , jelikož se jedná o dynamicky se rozvíjející oblast, a to nejen v eské republice, nýbrž ve všech moderních spole nostech. Jelikož se ve své praxi v nuji výkonu trest , mohu jen potvrdit skute nost, že alternativní tresty dnes p edstavují p evažující ást ukládaných trest . P es jejich nesporné výhody jsem však asto sv dkem také mnoha problém , které se objevují v rámci jejich výkonu. Domnívám se, že úsilí o nahrazování krátkodobých trest odn tí svobody r znými druhy alternativních trest je správné. Je však t eba mít na pam ti, že alternativní tresty by m ly být ukládány pouze v opodstatn ných p ípadech, s p ihlédnutím k individuální osobnosti každého pachatele. V opa ném p ípad se tyto tresty míjejí svým ú inkem, neúm rn zat žují soudy ve vykonávacím ízení a v d sledku p em ny v trest odn tí svobody zat žují i v znice. Mezi pachatele, kterým by alternativní tresty m ly být ukládány, bych za adila p edevším mladistvé, prvotrestané a pachatele mén závažné trestné innosti.
