- 75 - konstrukce v podstatě skrytě recipoval množství právních předpisů náležejících k jinému než čs. právnímu řádu a až na výjimky uznal i platnost rozhodnutí státních orgánů z doby nesvobody".204 Konečně prosazení československé kontinuity je pouze otázkou úzké skupiny osob. Požadoval bych zde přece jenom něco více. Chybí mi zde právě vůle národa udržet svou státnost, která byla za Protektorátu přece jen vyšší, ale téměř nulová v období II. republiky. Další ze zásadních bodů pak vidím v ustavení Slovenské národní rady vzniklé v prosinci na 1943 na základě tzv. Velikonoční dohody. Ta se prohlásila za nejvyšší orgán slovenského odboje a převzala na Slovensku veškerou moc. Tak byl založen právní dualismus. Navíc se tato postavila proti Benešově teorii politické a právní kontinuity Československa.205 Vzhledem ke složitosti celé problematiky, a to nejen samotné kontinuity, ale rovněž tak dílčích otázek ji provázejících, není možné podat jednoznačné vyjádření. A je to možná dobře, neboť další názory přináší další pohledy a možnosti zkoumání. Jakkoliv všeobecně přijímaná je teorie kontinuity dle mého názoru minimálně diskutabilní a s mnoha slabými místy, a to jak po stránce kontinuity právní, tak té státní. - 80 - Munich agreement and the results in terms of constitutional law Czechoslovakia was found in 1918 as a democratic country. The countries democratical character was grounded even in it's constitution. Main political leaders of the state supported the development of international law, system of collective security and the peaceful co-existence with other countries. In internal relations the state ensures the observation of human right and equality of conditions for everyone. "Our republic is an ideally democratical state" said foreman of Jewish party in 1938. But it was not enough for the others which sacrificed this democratic country to avoid contention with his totalitarian neighbour. On 30th September 1938, Great Britain, France, Italia and Germany signed the Munich agreement. Czechoslovakia which was not contracting party was contrainted on abandonment of large frontier areas on behalf of Germany. It was the British prime minister's policy of appeasement plan, which he hoped would sacrifice a little peaceful country, avoiding war with Germany. History showed us he was wrong and in one year the biggest tragedy in modern history befell the world in the appearance of Second World War.
