49 ZÁVĚR Indické hospodářství se po dlouhých letech uzavřenosti od roku 1991 otevírá. V tomto roce byla nastolena cesta postupných reforem (resp. liberalizace), která znamenala razantní posun i v politice vůči PZI. Indická vláda se rozhodla umožnit přístup zahraničnímu kapitálu na svůj trh hned z několika důvodů, z nichž nejhlavnější jsou modernizace technologií a rozšíření možností financování rozvoje. Celkovým efektem má být stimul hospodářského růstu. Není snadné kvantifikovat dopad přílivu PZI na hospodářství. PZI jsou ovšem součástí reforem, a ty své pozitivní dopady mají. To dokazuje vývoj HDP, když za reformovaným sektorem průmyslu a služeb nereformované zemědělství značně zaostává (vývoj ekonomických ukazatelů je součástí přílohy). Politika indické vlády vůči PZI se dá označit za velmi aktivní. Snaha těžit z procesu globalizace ve svůj prospěch se promítla do prostředků, kterými je politika PZI uskutečňována. Základní právní rámec na úrovni národní legislativy vytvářejí Zákon o společnostech, Devizový zákon a nařízení vlády týkající se procesu povolování PZI. Indie se uzavíráním bilaterálních dohod o ochraně investic a o zamezení dvojímu zdanění zařadila do hlavního celosvětového proudu a spolu s národní legislativou tak vytváří základní pilíře právní úpravy PZI. 66 Title: Economic and legal aspects of foreign direct investments on example of India Key words: International taxation, Protection of investments, Foreign direct investments (Mezinárodní zdanění, Ochrana investic, Přímé zahraniční investice) Abstract: The main goal of this paper is to look into economic and legal aspects of foreign direct (hereafter FDI) on the example of India as one of the most important global players in this field. The paper is composed of three chapters, each of them dealing with different aspects of FDI. Chapter one is introductory. It examines basic facts of FDI on general level as well as the Indian level. It also provides an outline of relevant Indian legislation towards FDI. Chapter two is subdivided into four parts and provides an answer to this question: How do states try to attract investments? Part one describes legislation of investment protection, part two describes legislation of international taxation, part three focuses on investment incentives and finally, part four gives us an example of institutions founded to support the investments.
