Abstract

Délka funkčního období prezidenta republiky a její dopad na fungování ústavního systému Páté francouzské republiky Abstrakt Tato práce pojednává o délce funkčního období prezidenta republiky a jejím vlivu na fungování francouzských ústavních institucí. Ačkoliv se práce zabývá vlivem tohoto faktoru na fungování současné, Páté republiky, její první kapitola mapuje i starší republikánskou historii od Velké francouzské revoluce. Ve zbytku první části jsou popisovány původní koncepce ústavy z roku 1958 a zavedení přímé volby prezidenta v roce 1962, poslední kapitola první části analyzuje neúspěšný pokus o zavedení pětiletého funkčního období hlavy státu v roce 1973. Druhá část práce popisuje fenomén kohabitací. V první kapitole této části jsou kohabitace vymezeny jako koncept, dále je popsána historie přístupu k hypotetickým kohabitacím v prvních dvaceti letech Páté republiky. Další čtyři kapitoly se věnují jednotlivým kohabitacím a zvláštnímu období z přelomu 80. a 90. let, kdy vládly menšinové vlády. Poslední kapitola druhé části analyzuje dopad kohabitací na instituce a na společnost. Ve třetí části autor prochází hlavní body kritiky sedmiletého funkčního období hlavy státu a jeho případné alternativy, dále připomíná obecná pravidla změn ústavy z roku 1958. The Length of the Presidential Term and Its Impact on the Functioning of the Constitutional System of the Fifth French Republic Abstract This thesis examines the length of the presidential term of office and its impact on the functioning of French constitutional institutions. Although the thesis focuses on the impact of this factor on the functioning of the current Fifth Republic, its first chapter also traces the history of the republic dating back to the French Revolution. The remainder of the first part describes the original concepts of the 1958 Constitution and the introduction of direct presidential elections in 1962; the final chapter of the first part analyzes the unsuccessful attempt to introduce a five-year term for the head of state in 1973. The second part of the thesis describes the phenomenon of cohabitation. The first chapter of this part defines cohabitation as a concept and then describes the history of approaches to hypothetical cohabitation scenarios during the first twentyyears of the FifthRepublic. The next four chapters focus on individual instances of cohabitation and the specific period at the turn of the 1980s and 1990s, when minority governments were in power.
