Výkon trestu a resocializace pachatelů mravnostní kriminality

Abstract

Diplomová práce se zabývá výkonem trestu odnětí svobody u osob odsouzených za mravnostní kriminalitu a možnostmi jejich resocializace v českém vězeňském systému. Cílem práce je analyzovat, jakým způsobem je s touto skupinou odsouzených ve výkonu trestu zacházeno, jaká specifická rizika jsou s jejich pobytem ve věznici spojena a jaké nástroje mohou přispívat ke snížení pravděpodobnosti jejich recidivy. Teoretická část práce nejprve vymezuje pojem mravnostní kriminality, její právní rámec a základní charakteristiky pachatelů a obětí. Následně se zaměřuje na obecné i specifické dopady vězeňského prostředí, včetně postavení odsouzených za mravnostní trestnou činnost ve vězeňské subkultuře. Samostatná pozornost je věnována nástrojům resocializace, zejména programu zacházení, specializovaným oddílům, standardizovaným programům a postpenitenciární péči. Praktická část práce vychází z kvalitativního výzkumu provedeného formou polostrukturovaných rozhovorů s odbornými zaměstnanci vybraných věznic. Získané poznatky umožňují porovnat teoretická východiska s reálnou praxí a ukázat, jakým způsobem jsou jednotlivé nástroje zacházení využívány v každodenním fungování věznice. 1 Abstract This thesis examines the execution of imprisonment of sex offenders and the possibilities of their resocialisation within the Czech prison system. The aim of the thesis is to show how these offenders are treated during imprisonment, what specific risks are associated with their presence in prison, and what tools may contribute to reducing the likelihood of their reoffending. The theoretical part first defines the concept of sexual offences, their legal framework, and the basic characteristics of offenders and victims. It then focuses on the general and specific impacts of the prison environment, including the position of sex offenders within the prison subculture. Separate attention is paid to resocialisation tools, in particular treatment programmes, specialised units, standardised programmes, and post-penitentiary care. The practical part is based on qualitative research conducted through semi-structured interviews with staff members of selected prisons. The findings make it possible to compare the theoretical framework with actual practice and to show how individual treatment tools are used in the everyday operation of prisons.
