Abstract

Ukládání alternativních trestů a jejich přeměny v tresty odnětí svobody Abstrakt Diplomová práce se zabývá problematikou alternativních trestů a jejich přeměn v nepodmíněné tresty odnětí svobody. Hlavním cílem práce je posoudit fungování alternativních trestů v praxi, analyzovat četnost jejich přeměn a zhodnotit, zda alternativní tresty skutečně naplňují svůj účel a představují efektivní nástroj trestní politiky. Práce vychází především ze statistických dat Ministerstva spravedlnosti České republiky za období let 2020-2025. Analyzována jsou data o počtech uložených alternativních trestů a o počtech jejich přeměn v nepodmíněné tresty odnětí svobody. Vedle statistických údajů práce využívá analýzu historické i současné právní úpravy, relevantní judikatury a poznatků získaných během odborné praxe u Probační a mediační služby. První část práce se věnuje teoretickým východiskům trestání, účelu trestu, principům restorativní justice a alternativním trestům obecně. Stěžejní část práce tvoří kapitoly zaměřené na trest obecně prospěšných prací, trest domácího vězení a peněžitý trest. The Imposition of Alternative Sanctions and Their Conversion into Custodial Sentences Abstract This master's thesis deals with the issue of alternative sanctions and their conversion into custodial sentences. The main aim of the thesis is to assess the functioning of alternative sanctions in practice, analyse the frequency of their conversions, and evaluate whether alternative sanctions truly fulfil their purpose and represent an effective instrument of criminal policy. The thesis is primarily based on statistical data provided by the Ministry of Justice of the Czech Republic for the period 2020-2025. The analysed data concern the numbers of imposed alternative sanctions and the numbers of their conversions into unconditional imprisonment sentences. In addition to statistical data, the thesis employs an analysis of both historical and current legislation, relevant case law, and findings obtained during professional practice at the Probation and Mediation Service. The first part of the thesis focuses on the theoretical foundations of punishment, the purpose of punishment, the principles of restorative justice, and alternative sanctions in general.
