Energy Charter Treaty, ECT, investment arbitration, investment protection, right to regulate, climate transition, European Union law, intra-EU arbitration, sunset clause, inter se arrangementsDiplomová práce zkoumá, do jaké míry je Smlouva o energetické chartě po modernizaci přijaté v roce 2024 schopna zajistit přiměřenou ochranu energetických investic, aniž by nepřiměřeně omezovala regulatorní prostor států při provádění klimatické a energetické transformace a aniž by v intraunijních vztazích narušovala autonomii práva Evropské unie. Práce vychází z právně-dogmatické, analytické a normativní metody.
This master's thesis examines the extent to which the Energy Charter Treaty, following the modernisation adopted in 2024, is capable of providing adequate protection for energy investments without disproportionately limiting the regulatory space of states in carrying out the climate and energy transition, and without undermining the autonomy of European Union law in intra-EU relations. Based on doctrinal legal analysis combined with case-law analysis and normative assessment, the thesis outlines the historical and systemic framework of the ECT, the main standards of investment protection, the investor-state dispute settlement mechanism, the relationship between the Treaty and EU law, and the legal and institutional options for its further development. The thesis shows that the original ECT regime created substantial tension between investment protection and the right of states to regulate in the public interest. This tension did not arise solely from the protection of fossil fuel investments, but primarily from the combination of broadly defined investment protection, the fair and equitable treatment standard, the protection of legitimate expectations, indirect expropriation, the most-favoured-nation clause, the umbrella clause, and direct investor access to international arbitration. In the EU...
