Article 102 TFEU, competition law, digital markets, dominant position, Google, monopoly, Sherman ActZneužití dominantního postavení a protiprávní monopolizace: Komparativní analýza přístupů EU a USA v případech Google Abstrakt Tato diplomová práce zkoumá, do jaké míry rámce soutěžního práva EU a USA konvergují ve svém přístupu k monopolům v digitálním světě podle článku 102 SFEU a oddílu 2 Shermanova zákona. Tento cíl je naplněn skrze komparativní analýzu dvou přelomových řízení proti stejnému soutěžiteli: Google Shopping v EU a Google Search v USA. Práce se zaměřuje na tři analytické roviny, konkrétně na prokázání dominantního postavení a monopolní síly, zjištění vylučovacího jednání a na koncepci nápravných opatření. Kapitoly 1 a 2 poskytují přehled právních rámců a skutkové pozadí případů, zatímco Kapitola 3 je věnována samotné komparativní analýze. Analýza se zprvu soustředí na to, jak se oba případy shodují v přístupu k vymezení relevantního trhu, zejména ve vztahu k službám poskytovaným zdarma a vícestranným trhům, a na důkazy použité k prokázání požadované tržní síly. Práce dále zkoumá, jakým způsobem obě jurisdikce využily poznatků behaviorální ekonomie k podložení svých teorií uzavření trhu, konkrétně zkreslení prominence (prominence bias) a zkreslení výchozího nastavení (default bias). Abuse of Dominant Position and Unlawful Monopolization: A Comparative Analysis of the EU and US Approaches in the Google Cases Abstract This thesis examines how the EU and US antitrust frameworks converge in their assessment of digital monopolies under Article 102 TFEU and Section 2 of the Sherman Act. This goal is achieved through a comparative analysis of two landmark proceedings against the same incumbent: Google Shopping in the EU and Google Search in the US. Specifically, the thesis focuses on three dimensions, namely the establishment of a dominant position and monopoly power, the finding of exclusionary conduct and design of remedies. Following an overview of the legal frameworks and factual background in Chapters 1 and 2, the comparative analysis is conducted in Chapter 3. The analysis first focuses on how the two cases converged in their approaches to the definition of the relevant market, particularly in relation to zero-priced services and multi-sided markets, and the evidence they employed to establish the requisite market power.
