Abstract

1 Constitutional Aspects of the Status of Intersex Persons in the Czech Republic Abstract This thesis examines the constitutional aspects of the legal status of intersex persons in the Czech Republic, with a particular focus on bodily integrity, non- discrimination, and the limits of current medical practice. The thesis first defines the concept of intersexuality and analyses the terminological and historical development of approaches towards persons with variations of sex characteristics, while reflecting the tension between medical and human-rights-based understandings of this issue. It subsequently focuses on so-called "normalising surgeries" performed on intersex children without their informed consent and assesses their compatibility with the right to bodily integrity and personal inviolability under Article 7(1) of the Charter of Fundamental Rights and Freedoms. The thesis further analyses the constitutional and anti-discrimination framework protecting intersex persons in the Czech context and highlights systemic shortcomings of the Czech legal framework, particularly the absence of explicit recognition of "sex characteristics" as a protected ground of discrimination. Ústavněprávní aspekty postavení intersex osob v ČR Abstrakt Tato práce se zabývá ústavněprávními aspekty postavení intersex osob v ČR se zaměřením na ochranu tělesné integrity, zákaz diskriminace a limity současné medicínské praxe. Práce nejprve vymezuje samotný pojem intersexualita, analyzuje terminologické a historické proměny přístupů k osobám s variacemi pohlavních znaků a reflektuje napětí mezi medicínským a lidskoprávním pojetím této problematiky. Následně se zaměřuje na problematiku tzv. normalizačních operací prováděných na intersex dětech bez jejich informovaného souhlasu a posuzuje jejich slučitelnost s právem na nedotknutelnost osoby a tělesnou integritu podle čl. 7 odst. 1 Listiny základních práv a svobod. Práce dále analyzuje ústavní a antidiskriminační rámec ochrany intersex osob v českém kontextu a poukazuje na systémové nedostatky české právní úpravy, zejména absenci explicitního zakotvení "pohlavních znaků" mezi chráněné diskriminační důvody. Pozornost je věnována také bariérám v přístupu ke spravedlnosti, vysoké míře latentní diskriminace, problematice uchovávání zdravotnické dokumentace a omezené dostupnosti podpůrných mechanismů pro intersex osoby a jejich rodiny.
