Principle of non-refoulement, readmission agreements, Frontex74 Návraty neúspěšných uchazečů o azyl z Evropské unie a jejich limity z pohledu lidských a základních práv Abstrakt Tato diplomová práce se zabývá problematikou návratů neúspěšných uchazečů o azyl z Evropské unie do zemí původu nebo třetích zemí, a to především z pohledu limitů vyplývajících z mezinárodní ochrany lidských práv a základních práv. Ústředním bodem analýzy je zásada nenavracení (non-refoulement), která zakazuje vyhoštění osob do míst, kde by byl ohrožen jejich život či svoboda nebo kde by jim hrozilo mučení, nelidské či ponižující zacházení. Práce nejprve analyzuje zakotvení zásady nenavracení v Ženevské úmluvě o právním postavení uprchlíků, Evropské úmluvě o lidských právech a v právním řádu Evropské unie. Zvláštní pozornost je věnována judikatuře Evropského soudu pro lidská práva, zejména rozhodnutím ve věcech Soering proti Spojenému království, Chahal proti Spojenému království a Saadi proti Itálii, která potvrdila absolutní povahu zákazu mučení a jeho význam pro návratovou politiku. V další části práce jsou kriticky hodnoceny vybrané nástroje návratové politiky Evropské unie, zejména koncepty bezpečné země původu a bezpečné třetí země a vybrané readmisní dohody. 75 Returns of Unsuccessful Asylum Seekers from the European Union and Their Limits from the Perspective of Human and Fundamental Rights Abstract This diploma thesis examines the return of unsuccessful asylum seekers from the European Union to their countries of origin or third countries, focusing on the limitations arising from international human rights and fundamental rights protection. The central concept of the analysis is the principle of non-refoulement, which prohibits the expulsion of individuals to places where their life or freedom would be threatened or where they would face torture, inhuman, or degrading treatment. The thesis first analyses the legal foundations of the principle of non-refoulement within the framework of the 1951 Geneva Convention relating to the Status of Refugees, the European Convention on Human Rights, and the legal order of the European Union. Particular attention is paid to the case law of the European Court of Human Rights, especially the judgments in Soering v. the United Kingdom, Chahal v. the United Kingdom, and Saadi v. Italy, which confirmed the absolute nature of the prohibition of torture and its implications for return policies.
