Abstract

Legality and legitimacy of the dissolution of Czechoslovakia Abstract This diploma thesis deals with the issue of legality and legitimacy of the dissolution of Czechoslovakia, which occurred at the end of 1992. The aim of the thesis is to assess whether the dissolution of the federation took place in accordance with the then constitution and whether it was legitimate from the point of view of democratic values and the will of the people. The thesis is divided into five parts. The first part places the dissolution of Czechoslovakia in a historical and political context. The second part describes in more detail the phenomenon of disinformation movements questioning the legitimacy of today's states and presents the reservations that these groups articulate regarding the dissolution of Czechoslovakia. The third part of this thesis defines the theoretical framework through the concepts of legality and legitimacy and the criteria for their assessment. The fourth part forms the core of the thesis. This part presents individual reservations regarding the dissolution of Czechoslovakia from the point of view of the theory defined in the third part. The fifth part then contains a comprehensive assessment of the dissolution of Czechoslovakia and offers an answer to the question of whether it was legal and legitimate....

Legalita a legitimita zániku Československa Abstrakt Tato diplomová práce se zabývá otázkou legality a legitimity zániku Československa, který se udál koncem roku 1992. Cílem práce je posoudit, zda zánik federace proběhl v souladu s tehdejší ústavou a zda byl legitimní z hlediska demokratických hodnot a vůle lidu. Práce je rozdělena do pěti částí. První část zasazuje zánik ČSFR do historického a politického kontextu. Druhá část blíže uvádí fenomén dezinformačních hnutí zpochybňujících legitimitu dnešních států a představuje výhrady, jež tyto skupiny vůči zániku Československa artikulují. Třetí část této práce definuje pojmy legalita a legitimita a stanovuje kritéria jejich hodnocení. Čtvrtá část tvoří jádro práce. V této části jsou analyzovány jednotlivé výhrady vůči zániku Československa z hlediska teorie vymezené ve třetí části. Pátá část pak obsahuje souhrnné zhodnocení zániku Československa a nabízí odpověď na otázku, zdali byl legální a legitimní. Autor dochází k závěru, že zánik ČSFR byl formálně legální, přestože zvolený postup vykazoval v práci formulované nedostatky. Z hlediska legitimity pak práce identifikuje demokratický deficit v podobě rezignace tehdejší politické reprezentace na zjištění vůle lidu, který nedostal možnost vyjádřit se k otázce existence vlastního státu.
