Abstract

The Composition of Ideas within the People and Its Influence on Law-Making: The Legitimising Relationship in a Heterogeneous Society Abstract The thesis examines the relationship between the composition of ideas within the people and the process of law-making in the conditions of an inherently heterogeneous society. It proceeds from the premise that the legitimacy of a specific legal order depends on the degree of overlap between the ideas of the sovereign people and those of the norm-creating representation. To capture this relationship, the thesis constructs a theoretical model based on the interaction of two sets of ideas: the ideas of the people in general (A) and the ideas of the defined representation (B). Their dynamic relationship, reflected in legal norms, determines both the form and the level of effectiveness of law. The research investigates various mechanisms through which ideas are transmitted from the societal sphere of the people into the institutional sphere and subsequently into positive law. It focuses on identifying factors that modify or distort this process of transmission. Ideová skladba lidu a její vliv na normotvorbu: legitimizační vztah v heterogenní společnosti Abstrakt Diplomová práce se zabývá vztahem mezi ideovou skladbou lidu a procesem normotvorby v podmínkách inherentně heterogenní společnosti. Východiskem analýzy je předpoklad, že legitimita právního řádu je podmíněna mírou ideového překryvu mezi suverénním lidem a normotvornou reprezentací. Práce proto konstruuje teoretický model založený na interakci dvou ideových množin: idejí lidu (A) a idejí reprezentace (B), jejichž dynamický vztah skrze reflexi v právních normách určuje podobu i faktickou účinnost práva. Výzkum sleduje mechanismy přenosu idejí z prostředí lidu do institucionální sféry a odtud v platné právo. Soustřeďuje se na identifikaci faktorů, které tento přenos modifikují či deformují. Zvláštní pozornost je věnována podobě vnitřní heterogenity lidu, dynamice většin a menšin a roli kolektivních identit, jazykových, kulturních, historických, náboženských a socioekonomických. Tyto identity jsou analyzovány jako faktory ovlivňující genezi a především relevanci normotvorných idejí v politickém a právním procesu.
