Tato práce se věnuje výzkumné otázce "Jak se tradiční institucionální struktury prolínají nebo střetávají s moderní politickou participací na národní a lokální úrovni?" Prostřednictvím komparativní analýzy dvou případů - indiánské komunity Nasa v regionu Cauca a indiánské komunity Wayúu v regionu La Guajira - analyzuji mechanismy interakce mezi tradičními a moderními institucemi v období 2000-2025. Teoretický rámec práce tvoří tři vzájemně doplňující se koncepty: institutional layering Mahoneyho a Thelena, právní pluralismus Boaventury de Sousa Santose a O'Donnellova teorie hnědých zón. Zjištění ukazují, že charakter interakce mezi tradičními a moderními institucemi závisí především na míře institucionalizace dané komunity. Komunita Nasa prostřednictvím organizace CRIC vybudovala intermediární struktury umožňující efektivní přeměnu formálních ústavních nároků v reálnou politickou moc. Komunita Wayúu, jejíž klanová organizace centrální koordinaci strukturálně neumožňuje, operuje na principu selektivní a paralelní existence obou systémů. The Colombian Constitution of 1991 represents a landmark case of multicultural constitutionalism in Latin America. This thesis addresses the research question: "How do traditional institutional structures intersect or conflict with modern political participation at the national and local level?" Through a comparative analysis of two cases - the Nasa indigenous community in the Cauca region and the Wayúu indigenous community in the La Guajira region - I examine the mechanisms of interaction between traditional and modern institutions over the period 2000- 2025. The theoretical framework consists of three complementary concepts: institutional layering as developed by Mahoney and Thelen, legal pluralism by Boaventura de Sousa Santos, and O'Donnell's theory of brown areas. The findings show that the nature of interaction between traditional and modern institutions depends primarily on the degree of institutionalisation of the community in question. The Nasa community,through the organisationCRIC, has built intermediarystructures that enable the effective translation of formal constitutional claims into real political power.
