internet of things, data, privacyInternet věcí a právo Disertační práce se zaměřuje na oblast ochrany soukromí v rámci internetu věcí, který představuje zhmotnění světa neustálého sledování popsaného v románu George Orwella 1984. Cílem disertační práce bylo odpovědět na otázku, zda platné právní předpisy poskytují dostatečnou ochranu soukromí uživatele zařízení internetu věcí (dále jen "IoT zařízení") v kontextu soukromoprávních vztahů. Dílčí závěry druhé, třetí a čtvrté kapitoly dokládají, že právní úprava institutu souhlasu jako nástroje kontroly nad soukromím a právní úprava informačních povinností vůči uživateli jako prostředku pro zajištění transparentnosti nedostatečně zohledňují stav technologického vývoje a chování uživatelů. V důsledku toho tyto instituty nedosahují svého účelu ochránit soukromí uživatele. Věcný rozsah ustanovení čl. 5 odst. 3 směrnice 2002/58/ES (směrnice ePrivacy) vede k právní nejistotě ohledně sledovacích technologií, na které se ochrana vztahuje. Zároveň příliš úzké vymezení výjimek z požadavku na souhlas uživatele má za následek nedůvodné vyžadování kontroly uživatele tam, kde by uplatnění výjimky nevedlo ke snížení ochrany. I přes existující regulatorní doporučení ohledně transparentnosti právní úprava postrádá požadavek využít technické možnosti IoT zařízení pro zajištění smysluplné kontroly...
Internet of Things and Law The dissertation focuses on the area of privacy protection within the Internet of Things, which represents the embodiment of the world of constant surveillance described in George Orwell's novel 1984. The aim of the dissertation was to answer the question of whether the current legal regulations provide sufficient protection of the privacy of users of Internet of Things devices (the "IoT devices") in the context of private law relations. The partial conclusions of the second, third and fourth chapters demonstrate that the legal regulation of the consent as a legal instrument for controlling privacy and the legal regulation of information obligations towards the user as a means of ensuring transparency do not sufficiently take into account the state of technological development and user behavior. As a result, these legal instruments do not achieve their purpose of protecting user privacy. The substantive scope of the provisions of Article 5(3) of the Directive 2002/58/ES (ePrivacy Directive) leads to legal uncertainty regarding the surveillance technologies to which protection applies. At the same time, the too narrow definition of exceptions to the requirement for user consent results in an unreasonable requirement for user control where the application of the exception...
