Abstract

Limitations and exceptions to copyright in the on-line environment Abstract In recent decades, the development of the internet in particular has enabled the quantitatively uncontrollable and qualitatively highly advanced making of reproductions of copyrighted works. However, a large part of these works transmitted over the internet does not consist of users' own creations, but rather the works of other authors used on the basis of a licence or non-contractual instruments of copyright use (exceptions and limitations). Without exceptions and limitations - such as free use for private purposes, temporary acts of reproduction, exceptions for parody or caricature, quotations, and others - today's online world could not legally function. On the other hand, this constitutes an interference with the economic rights of authors; thus, it is necessary to balance the protection of their interests as well. Will the current legal regulation of exceptions and limitations to copyright withstand the rapidly changing online environment affected by the use of artificial intelligence? And can it strike a balance between technological progress and the protection of authors' interests? Mimosmluvní instituty užití autorských děl v on-line prostředí Abstrakt V posledních desetiletích umožnil zejména rozvoj internetu kvantitativně nekontrolovatelné a kvalitativně velmi dokonalé pořizování rozmnoženin autorských děl. Velkou část těchto děl přenášených přes internet však netvoří vlastní díla uživatelů, nýbrž jde o díla jiných autorů užívaná na základě licence či mimosmluvních institutů užití autorských děl. Bez mimosmluvních institutů, jako jsou např. volná užití pro osobní potřebu, dočasné rozmnoženiny, výjimky pro parodii či karikaturu, citace a další, by dnešní online svět nemohl legálně fungovat. Na druhé straně jde o zásah do majetkových práv autorů, je tak nutné vyvažovat i ochranu jejich zájmů. Obstojí tedy současná právní úprava mimosmluvních institutů užití autorských děl v rychle se měnícím online prostředí zasaženém příchodem umělé inteligence? A dokáže najít rovnováhu mezi technologickým pokrokem a ochranou zájmů autorů? Cílem práce je popsat specifika mimosmluvních institutů užití autorských děl v online prostředí, porovnat právní úpravu de iure s de facto praxí na internetu, kde se chování subjektů často odchyluje od normativních předpokladů, a identifikovat oblasti, kde jsou hranice úpravy nejasné a kde by bylo vhodné se pro futuro zamyslet nad úpravou jinou.
