69 Abstrakt Soudní federalismus v EU a USA: institucionální rámec, jurisdikce a dopady na autonomii států Tato diplomová práce se věnuje komparativní analýze modelů soudního federalismu v rámci Evropské unie a ve Spojených státech amerických. Ústředním tématem je dynamický vztah mezi centrální soudní mocí, zastoupenou Nejvyšším soudem USA a Soudním dvorem EU, a soudními soustavami jednotlivých států. Vzhledem k odlišné právní povaze obou entit práce definuje federalismus nikoliv jako atribut státnosti, ale jako funkční uspořádání celku založené na vertikální dělbě suverenity mezi centrum a státy, ukotvené v konstitutivních listinách. V tomto smyslu je soudní federalismus chápán jako systém rozdělení pravomocí mezi centrální a státní soudní orgány a vztahy mezi nimi. Hlavní výzkumná otázka práce se zaměřuje na komparaci efektivity těchto modelů v procesu unifikace centrálního práva a posouzení dopadů nastavení systémů na reziduální autonomii států, a to v rovině materiální i procesní. Metodologicky práce vychází z teoretického rámce soudního federalismu Jeffreyho Stevena Gordona, který jej člení do tří dimenzí - institucionální, jurisdikční a jurisprudenční. 70 Abstract Judicial Federalism in the EU and the US: Institutional Framework, Jurisdiction, and Impact for State Autonomy This thesis focuses on a comparative analysis of judicial federalism models within the European Union and the United States of America. The central theme is the dynamic relationship between the central judicial power, represented by the US Supreme Court and the Court of Justice of the European Union, and the judicial systems of individual states. Given the different legal nature of both entities, the thesis defines federalism not as an attribute of statehood, but as a functional arrangement of the whole, based on a vertical division of sovereignty between the center and the states, enshrined in the constitutive documents. In this sense, judicial federalism is understood as a system of division of powers between central and state judicial authorities and the relationships between them. The main research question of the thesis focuses on comparing the effectiveness of these models in the process of central law unification and assessing the impact of the systems' settings on the residual autonomy of states, both in substantive and procedural terms.
