Abstract

Podstatní znaky právního institutu vzhledem k možnosti jeho tokenizace Abstrakt Tato diplomová práce se zaměřuje na problematiku podstatných znaků právního institutu v kontextu jeho technologické transformace prostřednictvím tokenizace na blockchainu. Práce se soustředí na analýzu teoretických a technických předpokladů, které podmiňují úspěšný převod právních institutů do digitální podoby, aniž by došlo k narušení jejich vnitřní podstaty. Klíčovým problémem, který práce adresuje, je identifikace hranice mezi objekty matematicky vyjádřitelnými a těmi, které vyžadují nezbytný lidský prvek a vysokou míru sociální interakce. V teoretické části je tento problém řešen syntézou české a slovenské právně-didaktické nauky a normativního institucionalismu Oty Weinbergera. Výsledkem je vymezení univerzálních podstatných znaků právního institutu, jako je jeho ukotvení v sociální realitě, funkce stavebního kamene právního systému a vnitřní integrace normativních a hodnotových regulativů. Diplomová práce argumentuje, že tokenizovatelnost institutu není určena jeho příslušností k právnímu odvětví, ale jeho vnitřní strukturou. 1 Essential features of the legal institute with regard to the possibility of its tokenization Abstract This master's thesis focuses on the essential characteristics of a legal institute in the context of its technological transformation through tokenization on the blockchain. The thesis analyzes the theoretical and technical prerequisites for the successful transfer of legal institutes into digital form without disrupting their inherent nature. The key problem addressed is the identification of the boundary between objects that can be expressed mathematically and those that require a necessary human element and a high degree of social interaction. In the theoretical section, this issue is addressed through a synthesis of Czech and Slovak legal- didactic doctrine and the normative institutionalism of Ota Weinberger. The result is a definition of the universal essential characteristics of a legal institute, such as its grounding in social reality, its function as a building block of the legal system, and the internal integration of normative and evaluative regulations.
