Abstract

Právní úprava ochrany městské zeleně Abstrakt Předmětem diplomové práce je analýza právní úpravy ochrany městské zeleně v českém právním řádu, s ohledem na relevantní unijní a mezinárodní závazky. Vychází z předpokladu, že zeleň není pro urbanizované prostředí pouhým estetickým či rekreačním doplňkem, nýbrž svébytnou funkční infrastrukturou, která městům poskytuje nezastupitelné ekologické, klimatické a sociální služby. Práce přistupuje k problematice ze tří oblastí - klimatického práva, ochrany přírody a krajiny a územního plánování - v rámci nichž systematicky mapuje relevantní právní nástroje, jejich vzájemné vazby i nedostatky. Kapitola věnovaná klimatickému právu analyzuje ochranu městské zeleně v rámci národních a lokálních adaptačních strategií a akčních plánů. Poukazuje na absenci rámcového klimatického zákona, v jejímž důsledku jsou klimatické závazky relevantní pro ochranu zeleně rozptýleny napříč sektorovými předpisy. V části věnované ochraně přírody a krajiny jsou podrobně analyzovány instituty zákona č. 114/1992 Sb., o ochraně přírody a krajiny, zejména územní systém ekologické stability, obecná ochrana dřevin, kácení dřevin a náhradní výsadba, a to v pořadí od nástrojů plošné ochrany po ochranu individuálních zelených prvků. Legal Regulation of Urban Greenery Protection Abstract The thesis examines the legal regulation of urban greenery protection under Czech law, with regard to relevant EU and international obligations. It is based on the premise that greenery is not merely an aesthetic supplement to the urban environment, but a functional infrastructure that provides cities with irreplaceable ecological, climatic and social services. The thesis approaches the issue from three perspectives - climate law, nature and landscape protection, and spatial planning - systematically mapping the relevant legal instruments, their interrelationships and shortcomings. The chapter on climate law analyses the protection of urban greenery within national and local adaptation strategies and action plans. It highlights the absence of a framework climate act, as a result of which climate obligations relevant to greenery protection are dispersed across sectoral regulations. The part on nature and landscape protection analyses the instruments of Act No. 114/1992 Coll., on Nature and Landscape Protection, in particular the territorial system of ecological stability, general protection of woody plants, tree felling and compensatory planting proceeding from instruments of general protection to those protecting specific green elements.
