Abstract

Institute of contributions and investment within the framework of the settlement of community property of spouses Master thesis Ludmila Tolarová Abstract The master thesis deals with contributions and investments in the system of settlement of community property. The aim of the thesis is to analyze the legal regulation of contributions and investments in the settlement of joint property of spouses, to evaluate its functionality and possible application impacts, all with regard to a comparison with selected foreign legal systems. The first chapter of the thesis deals with the concept of contributions and investments in general, while the second chapter focuses on related aspects of investments and contributions. The third chapter contains the valorization and reduction of contributions and investments with an assessment of the impact of case law on the concept of this institution. The fourth chapter assesses foreign legislation in relation to contributions and investments. In conclusion, the shortcomings of the legal regulation are assessed and possible solutions to the problematic aspects in question are proposed - a change in the concept of community property or ways of increasing the awareness of spouses' about the legal regulation of the community property. Institut vnosů a investic v rámci vypořádání společného jmění manželů Diplomová práce Ludmila Tolarová Abstrakt Diplomová práce se zabývá vnosy a investicemi v systematice vypořádání společného jmění manželů. Cílem práce je analyzovat právní úpravu vnosů a investic v rámci vypořádání společného jmění manželů, zhodnotit její funkčnost a případné aplikační dopady, to vše s přihlédnutím ke srovnání s vybranými zahraničními právními řády. První kapitola diplomové práce se zabývá institutem vnosů a investic v obecné rovině, druhá kapitola se věnuje souvisejícím aspektům investic a vnosů. Třetí kapitola vysvětluje princip valorizace a redukce vnosů a investic spolu se zhodnocením dopadů judikatury na pojetí tohoto institutu. Čtvrtá kapitola posuzuje zahraniční právní úpravu ve vztahu k vnosům a investicím. V závěrečné páté kapitole jsou zhodnoceny nedostatky právní úpravy a navržena možná řešení předmětných problematických aspektů - změna koncepce společného jmění či způsoby zvýšení informovanosti manželů o právní úpravě manželského majetkového režimu.
