theft, recidivism, punishmentTrestání recidivy u trestného činu krádeže de lege lata a de lege ferenda Abstrakt Diplomová práce posuzuje, zda je česká právní úprava trestání recidivních krádeží podle § 205 odst. 2 trestního zákoníku účelná a zda odpovídá požadavkům moderního trestního práva, zejména z hlediska proporcionality, subsidiarity trestní represe a schopnosti naplňovat účel trestu jako ochranu společnosti. Metodologicky vychází z historické analýzy vývoje postihu opakovaných krádeží, komparace s německým a rakouským právem, z rozboru recentní judikatury českých soudů a odborné diskuse. Práce ukazuje, že § 205 odst. 2 trestního zákoníku má rigidní konstrukci, která přesouvá těžiště trestnosti z materiální závažnosti konkrétního činu na trestní minulost pachatele, a tím umožňuje kriminalizovat i jednání nepatrné hodnoty, jež by u prvopachatele představovala přestupek. V aplikační praxi se tato konstrukce promítá do ukládání krátkodobých nepodmíněných trestů odnětí svobody i při způsobení velmi nízké škody, prostor pro materiální korektiv v podobě subsidiarity je přitom judikaturou vykládán spíše restriktivně. Punishment of Recidivism in the Offence of Theft de lege lata and de lege ferenda Abstract The thesis examines whether the Czech legal regulation of punishment for repeated theft under § 205(2) of the Criminal Code is effective and whether it meets the requirements of modern criminal law, regarding proportionality, the principle of subsidiarity of criminal repression, and the ability to fulfil the purpose of punishment as the protection of society. Methodologically, the thesis is based on a historical analysis of the development of sanctions for repeated theft, a comparison with German and Austrian law, an analysis of recent case law of Czech courts, and the relevant academic debate. The thesis demonstrates that § 205(2) of the Criminal Code is based on a rigid construction that shifts the focus of criminal liability from the material seriousness of the specific conduct to the offender's criminal history, thereby allowing the criminalisation of conduct of negligible value that would constitute only an administrative offence if committed by a first-time offender. In judicial practice, this construction results in the imposition of short-term unconditional custodial sentences even in cases involving minor damage, while the scope for applying a material corrective in the form of subsidiarity is interpreted...
